CONDITIONS AND HOW TO HIRE |

|
|
Hirer' Refers to person, company or establishment renting equipment. 'Kayell' Refers to Kayell Qld Pty Ltd. The acceptance of equipment by the Hirer or their agent implies total acceptance of these terms and conditions which cannot be changed, in part or in whole, by any representative of Kayell, expressed or implied. |
Hire periods - |

|
|
|
DAY: |
A period of 24 hours (or part thereof) from the time equipment leaves Kayell on the first day, terminating at the same time on the second day. |
|
This is the shortest rental period acceptable. |
|
|
|
WEEKEND: |
The period between 4pm on a Friday afternoon up to 10am on the Monday morning. |
|
|
WEEK: |
A seven day period, timed as above termination occurring at the same time and day of the second week. |
|
MONTH: |
A four week period with termination occurring at the same time four weeks in advance. |
|
|
COLLECT/RETURN |
|
|
|
|
Rental charges commence from the time and date the equipment leaves Kayell premises and only terminate when they are received back at Kayell premises. Should the customer fail to return the equipment by the due date and time, the hire charge payable will be the daily hire charge for the equipment concerned, for each overdue day. Transit times are therefore considered as part of the rental period. Carriage and packaging charges will also be charged to the Hirer. Note: Kayell cannot accept any liability, consequential or otherwise, for delay in transit causing late arrival of any equipment. |
BOOKING CANCELLATION |

|
|
Cancellation of any booking must be made in writing and received by Kayell no later than 48 hours prior to the intended start of any booking. Failure to comply with this may involve the Hirer in a charge equal to 50% of the scheduled rental charges. |
DEPOSITS |
|
|
|
|
|
NON ACCOUNT CUSTOMERS- All equipment is hired against a security deposit equal to the amount of the damage waiver. Currently $300.00 The deposit must be made in the form of an acceptable credit card, with two methods of identification. |
ACCOUNT CUSTOMERS - All rental charges will be invoiced to their account, upon production of an official order at the time the equipment is being removed from Kayell premises.

LOSS & DAMAGE |
|
|
|
|
Loss of and or damage to equipment and all costs incurred in the repair or replacement of such equipment, together with the rental fees lost, due to the equipment not being available for rent, is the sole responsibility of the Hirer. Kayell shall require proof that the Hirer's insurance adequately covers such loss or damage. It is important that the Hirer carefully checks the listing of equipment on the rental invoice since, in the event of non-return of components (including caps, covers, cables etc) the Hirer is responsible for the cost of replacement at our normal list prices. Incorrect entries on a rental invoice must be brought to the attention of Kayell at the time of issue; following removal of equipment from Kayell premises, such entries cannot be altered. |
LOSS AND DAMAGE WAIVER |

|
|
Where the Hirer does not have adequate proof of insurance, Kayell's damage waiver is compulsory. Upon acceptance and payment by the Hirer of the damage waiver fee, Kayell agrees to waive its rights to claim for loss or damage to the equipment for any sum in excess of the security deposit.

NB: The waiver shall not apply to the following: |

|
|
a) Damage caused by misuse.
|
|
|
|
|
b) Damage caused by operation of the equipment in contravention of these conditions of hire.
|
|
c) Loss by any means other than a Police crime report stating that the loss was theft, as a result of forced entry.
|
USE OF EQUIPMENT |
|
|
|
|
It is assumed that the Hirer, or his agent, has sufficient skill and knowledge to operate the rented equipment correctly. The supply of instructional literature cannot be guaranteed. It is the responsibility of the hirer, or his agent, to ensure that the equipment being rented is suitable for the purpose intended, prior to the equipment leaving Kayell. The customer shall not take the equipment out of Australia, nor without the specific prior consent in writing of Kayell allow it to be used on any abnormal or hazardous assignment. Equipment is not to be transported in, or used in, any helicopters or light aircraft without Kayell's specific written consent, which may be given if the customer has adequate proof of insurance cover for this risk. Nor is the equipment to be used where it could be affected by salt or water or atmospheric corrosion.

LIABILITY |

|
|
|
Kayell rental equipment is, where ever possible, maintained in accredited workshops and all equipment, to ensure items perform to specifications, is normally tested before and after every hiring; Kayell will therefore not accept any liability for break downs that occur while the equipment is on hire. We also will not accept any liability for shortages or incompleteness. However in the event of breakdown, Kayell will, subject to availability, endeavour to replace the item as soon as possible. |
NB: It is the responsibility of the hirer to check, for completeness and correct functioning and fitness, prior to their assignment. |
GENERAL |

|
|
In every case, equipment not returned promptly will be charged according to the next rental period. Availability of equipment depends on the prompt return of equipment in full working order by all hirers. Bookings are accepted on this understanding and in the event a specific item or items are not available due to late return or breakdown, Kayell cannot accept liability, consequential or otherwise. Kayell will endeavour to ensure every firm booking is honoured. It is the responsibility of the Hirer, or his agent, to carefully check all details and items contained within the rental contract/invoice that is issued at the time the equipment is being taken from Kayell. Any shortages or breakages, on the return of equipment will become the liability of the Hirer, chargeable at our current prices. Kayell rental equipment remains the property of Kayell at all times and cannot be pledged, loaned, re-hired, deposited or sold to a third party. |
